Another Great PACNY Conference - Part Two

As we discussed in our previous post, the Professional Abatement Contractors of New York's  (PACNY's) 20th Annual Environmental Conference was witty, intelligent, & had a magnetic personality.  Held at the Turning Stone Casino in Verona, New York for all three days was magnetic with excitement.  Wednesday night included the first annual PACNY Poker Tournament won by Mr. Chuck Kirch of Environmental Compliance Management Corp.  However, we digress, the Technical Session on Thursday continued after lunch with presentations from Dr. Bryan Bandli, PhD of RJ Lee Group on the "Quantification of Amphibole Asbestos in Loose Fill Vermiculite - A validation case study" written with an eye to New York State approving it for bulk vermiculite analysis.  Then Ed Cahill of EMSL presented on "Identifying and Dealing with Naturally Occurring Asbestos in Surveys".  Exhibit Hall break followed and the issuing of the wrist bands for the Vendor reception after the last presentation.

The final presentation of the Thursday Technical Session was Mr. Tom Laubenthal of The Environmental Institute (A division of ATC Group Services).  Mr. Laubenthal's presentation was on the "American Society of Testing Materials (ASTM) E2356-14 Standard Practice for Comprehensive Building Asbestos Surveys" which included a letter from the Environmental Protection Agency (EPA) regarding the ASTM standard and its relevance in performing asbestos surveys for compliance with the National Emissions Standards for Hazardous Air Pollutants' (NESHAP's) "thorough inspection" requirement.  The letter and the standard are extremely helpful information for performing a proper inspection in order to comply with the NESHAP regulations, which we will add to our asbestos inspector courses (a copy of the letter can be found at our Resource Page on our website, Click on the link to the Dropbox Folder.  The letter is in the EPA folder).  The day ended with the vendor reception in the Vendor Hall.  One of the interesting vendors was qub9 Environmental which is creating portable decontamination units from shipping containers.  Unfortunately, they didn't have a container at the conference to see how it would work.  We thank everyone who stopped by our booth to say hello and enter there card for the drawing on Friday.

There were 27 vendors in the vendor hall and the reception was a perfect way to end the Technical Session first day.
It was an honor for me to present on Friday with Mr. Bob Krell of IAQ Tech on the New York State (NYS) Mold Law Article 32.  A big Thank You! to everyone who encouraged me with my first presentation at PACNY.  Our presentation was very well-balanced between technical and overview, in my humble opinion.  The usual highlight of the last day of the conference is the panel from NYS Department of Labor (NYSDOL) led by Dr. Eileen Franko, Director of the Division of Safety and Health; which included Mr. James Meachum, P.E., manager of the Asbestos Control Program; Mr. Ed Smith, P.E. of the Engineering Services Unit; and "Mean" Mr. Kirk Fisher, manager of the License and Certification Unit.  Some of the highlights of the presentations by the panel included changes to Industrial Code Rule 56; additional inspections of school districts regarding compliance with the AHERA (Asbestos Hazard Emergency Response Act) regulation (Long Island School Districts can expect to see NYSDOL this spring); there will be a public comment period for rules and regulations under the new mold law (Article 32) and an expectation that mold supervisors may need to be present at mold projects; code officials must provide condemnation letters for demolition projects; emergency projects are handled on a case-by-case basis and the information should be forthright and accurate; and what consists of a contamination assessment.  Some of the changes to Code Rule 56 are removing the 1974 cut off date and adding responsibilities and teeth to the project monitor.  The conference ended with lunch and a final networking among attendees.

Just Over A Week Away - 20th Annual PACNY Environmental Conference

Just about 9 days away is the premier environmental conference for New York State.  The Professional Abatement Contractors of New York's (PACNY's) 20th Annual Environmental Conference is being held at the Turning Stone Casino in Verona, New York from Wednesday, February 24 to Friday, February 26, 2016.  The conference seems to get bigger and bigger each year. This year's conference should be another good one since it is the first conference since Article 32 New York State's (NYS's) Mold Law is in effect.  We are looking forward to Dr. Eileen Franko's presentation on New York State Department of Labor's (NYSDOL) update on the Mold Training on Wednesday and her leading the NYSDOL's panelists on Friday.  For those of you who don't know NYSDOL is charged with enforcing the new NYS Mold Law and has been enforcing NYS's asbestos regulations (Industrial Code Rule 56).  Joining Dr. Franko on Wednesday, will be other training regulators like Mr. Kevin Malone of NYS Department of Health (NYSDOH) updating us on asbestos training, Ms. Theresa Bourbon of Environmental Protection Agency (EPA) updating us on the Lead Renovator, Remodeling, & Painting (RRP) training, and Mr. Doug Miller from the Occupational Safety and Health Administration (OSHA) Outreach Education Center updating us on OSHA education updates.

Thursday's technical session will include presentations on Vermiculite & Zonolite by Mr. Ed Cottingham of the Zonolite Trust Fund and Mr. Bryan Bandhi of RJ Lee Group; Silica presentations from Mr. Jeffrey Prebish of OSHA, Dr. Michael Lax MD, and Mr. Jim Sorel CIH; Polychlorinated Biphenyls (PCBs) from Dr. Daniel Leftkowitz; and Asbestos presentations from Ed Cahill of EMSL and Tom Laubenthal.  After the presentations, there will be the usual cocktail & networking party in the vendor hall.  Visit Future Environment Design's (FED's) booth and meet Ms. Kimberly Granmoe and Ms. Sheryl Esposito, who will be giving out glove-guard gifts to all those who sign up for our Safety Suzy Monthly Newsletter along with a chance to win a $50 Amazon gift card.

EPA Proposes Expansion of Lead RRP Rule Into Public & Commercial Buildings

The Environmental Protection Agency (EPA) has issued an advance notice of proposed rulemaking concerning renovation, repair and painting activities on and in public and commercial buildings (P&CB).  The current regulation covers residences and child-occupied facilities (COF).  EPA is currently taking public comments regarding the document "Framework for Identifying and Evaluating Lead-Based Paint Hazards From Renovation, Repair, and Painting Activities in Public and Commercial Buildings".  This 23 page document provides a framework of how EPA intends on identifying health hazards and evaluating health risks regarding specific renovation activities.  Based on that evaluation, EPA will determine if regulatory intervention is necessary.

Specifically EPA is requesting comments on:
  • The utility of the approach discussed in the Framework to assessing risk to human health inside P&CBs as a result of P&CB renovations.
  • Making a hazard finding inside nearby homes and COFs as a result of P&CB renovations.
  • The overview of an analysis approach outlined in the Framework.

New? NYS Education Department Asbestos Clearance Air Sampling Requirements

On July 12, 2013, New York State Education Department (NYSED) released a table regarding the various asbestos clearance air sampling requirements.  The table compares the Environmental Protection Agency's (EPA) Asbestos Hazard Emergency Response Act (AHERA) regulation to the New York State Department of Labor's (NYSDOL) Industrial Code Rule 56 (ICR56) and the table has a center column designating what we assume to be NYSED's requirement for schools.  It is interesting to note that New York State Department of Health (NYSDOH) noted these items were a problem in 2009, when they were doing AHERA audits for EPA.  Visit Future Environment Design's Resource Page for the Asbestos Clearance Table Requirements from NYSED.

There is some very interesting information on this table.  An example of this is the requirement of 5 inside samples for asbestos projects that range from three (3) linear feet (LF) or square feet (SF) to < 160 SF or < 260 LF.  These samples are analyzed using the phase contrast microscope methodology (National Institute of Occupational Safety and Health (NIOSH) method 7400).   We wonder how many schools are actually doing five (5) samples inside the work area for small projects (> 10 SF or 25 LF but < 160 SF or 260 LF) or the minor projects (> 3 LF or SF to < 10 SF or 25 LF)?  

In actuality to comply with both AHERA and ICR56 for small projects (> 10 SF or 25 LF but < 160 SF or 260 LF), a school should also run a minimum of three (3) outside samples.  So, for a small project in a school in NYS the project air sampling technician should run five (5) samples inside each work area, three (3) samples outside each work area, and two (2) blanks.  This current table, with the adjustment mentioned above, provides Asbestos Air Sample Technicians with the total number of samples, based on the size of the project, necessary to clear an asbestos abatement work area located in a school that will comply with AHERA, NYSED, & ICR56.

EPA Issues a Compliance Order Against Buffalo's Public Housing Authority

The U.S. Environmental Protection Agency has issued a compliance order, charging Buffalo's Public Housing Authority with violations of the Federal Clean Air Act resulting in fines up to $25,000 a day for each violation.  See the WIVBTV video for the full story or Phil Fairbank's article "Housing Authority faces fines on asbestos" at BuffaloNews.com.
This is part 2 of the Kensington Heights housing project where the federal government has handed indictments of nine individuals and two contractors on felony criminal charges related to the asbestos removal project.  The 23-count indictment charges the contractors and individuals, including three inspectors -- one from the state, two from the city -- with improperly removing and disposing of asbestos at the complex.  EPA spokesman Michael Basile said the allegations against the authority are similar but are administrative charges, not criminal charges. The authority is alleged to have violated the EPA's National Emission Standards for Asbestos.
Basile says the Buffalo Municipal Housing Authority needs to first submit a plan of proper asbestos removal for what's left in the building, then a plan for a safe demolition.  "We want to make sure that the building is demolished and the removal of the asbestos is done in a safe manner to protect human health and the environment, not only for the people that are going to be working on the project, but for the people that live in the immediate area,” said Basile.  Basile says he hopes the fines will never be imposed, and believes the Public Housing Authority wants to get the asbestos removal and demo process done as soon as possible.  He says once the plans are developed and submitted to the EPA, the approval process should take less than two weeks.

Chemical Lab Safety Refresher in IH News

The current issue of the Industrial Hygiene News has an excellent article on laboratory safety called "A Chemical Lab Safety Refresher" written by Mr. Phillip G. Retallick, who is the Senior Vice President Regulatory Affairs for Clean Harbors.  The article covers the typical information regarding lab safety - training, storage, disposal, labeling, and compliance audits.  One of the more interesting sections was the discussion on the requirements of a good industrial hygiene program.  This section discussed the need for a worksite analysis and a well-defined and monitored work practices.  The need for a Chemical Abstract Service (CAS) Registry software and routine monitoring of the air to ensure lab staff are protected is not typically discussed.  The assumption is that sufficient ventilation will handle any potential problems.  However, how do you know you have sufficient ventilation?  Monitoring is the best way to ensure that.  The article list important resources such as the Environmental Protection Agency's (EPA) "Environmental Management Guide for Small Laboratories" and the Occupational Safety and Health Administration's (OSHA) hazardous materials portion (Section H) of 29 CFR 1910.  A short and to the point article on Lab Safety.

EPA Warns New York City Residents about Dangers of Illegal Pesticides

The Environmental Protection Agency (EPA), last week, conducted an investigation of businesses in several New York City neighborhoods revealing dangerous and illegal pesticides are widely available.  Federal and state experts conducted 47 inspections and found 16 different types of illegal pesticides.  The pesticides were not registered by EPA and consumers have no way of knowing how dangerous they are, because they were not subject to testing requirements or manufacturing controls that are required in the registration process. In all, nearly 350 illegal products were collected from the businesses in just three days.  Store owners and vendors found with the illegal pesticides were given a warning and told why selling these products are dangerous and illegal.  Separate but related criminal investigations conducted by EPA with the New York State Department of Environmental Conservation, the U.S Attorney’s Office, U.S. Customs, the U.S. Postal Service and the Manhattan District Attorney’s office produced similar results and several charges were made against individuals last week, resulting in 12 arrests.

EPA Regional Administrator Judith A. Enck said, "I encourage all New York City retailers to check their shelves and make sure all their pesticides have the required EPA labels.  Consumers should be careful to look for the EPA registration number printed on product labels, and to follow the directions for use, storage and disposal.  If a pesticide product does not have an EPA registration number, it should not be purchased.”
“The sale of illegal pesticides poses a direct threat to the health and safety of our community. In the cases charged by our Office, that threat was particularly imminent in the Chinatown neighborhood,” said District Attorney Vance. “Some of these illegal products look and smell like cookie crumbs, making them dangerously tempting to children.  Some of the other products are so toxic that one small vial can kill an adult male.  It is my hope that our collective criminal and civil law enforcement actions will prevent future injury or death.”
The inspections, which took place the week of September 12, targeted stores in neighborhoods in Brooklyn, Manhattan and Queens.  Among the items confiscated were various rodenticides, mosquito repellants and mothballs.  These items will be safely destroyed.
Under federal pesticides law, all products sold in the United States that contain pesticides must be registered with EPA.  Before a pesticide product is registered, the producer of the product must provide data from tests done according to EPA guidelines, to ensure that the product does not make people sick.  EPA then examines the ingredients and the way in which the product will be used, and assesses a wide variety of potential human health and environmental effects associated with use of the product.  Distributors and retailers are responsible for ensuring that all pesticides distributed and sold fully comply with the law.
Pesticides have been linked to various forms of illnesses in humans, ranging from skin and eye irritation to cancer.  Some pesticides may also affect the hormone or endocrine systems. In many situations, there may be non-chemical methods to control pests.   EPA recommends considering and using these methods as part of an overall pest management strategy.

EPA has created an illegal pesticides fact sheet in multiple languages, which it will be distributing to businesses and community organizations in the targeted neighborhoods.

In a separate series of actions earlier this week, the U.S. Department of Justice charged two New York City-based individuals, who together had distributed and sold thousands of packages of illegal pesticides in recent months, with misdemeanor violations of federal pesticide laws.  The Manhattan District Attorney’s office also charged 10 retail sellers with selling dangerous and illegal pesticides and with reckless endangerment.  Agents seized many more illegal pesticides from the individuals during their respective arrests.

Owner of Asbestos Abatement Training School Sentenced to Prison

Environmental Protection Agency Criminal Inves...Image via WikipediaIn November 2008, Albania DeLeon, former owner of Environmental Compliance Training (ECT), the country's largest asbestos abatement training school, fled the United States after her trial.  DeLeon was convicted of a broad range of charges including selling training certificates to thousands of illegal aliens who had not taken the mandatory training course.  Deleon then placed these unqualified individuals in temporary employment positions as certified asbestos abatement workers in public buildings throughout Massachusetts and New England.  Deleon was also convicted of encouraging illegal aliens to reside in the United States, making false statements about matters within the jurisdiction of the Environmental Protection Agency; procuring false payroll tax returns, and mail fraud. 
On October 30, 2010, law enforcement authorities in the Dominican Republic, working in conjunction with the U.S. Marshal’s Service, arrested her in the capital city of Santo Domingo, where she was living under an alias and had dyed her hair blonde. In November, 2010, she was extradited to the United States.  Yesterday, Albania DeLeon was sentenced to prison.   U.S. District Judge Nathaniel M. Gorton sentenced DeLeon, 41, formerly of Andover, Mass., to 87 months in prison to be followed by three years of supervised release.   She was also ordered to pay $1,200,939.45 in restitution to the Internal Revenue Service and $369,015 to AIM Mutual Insurance Company.
United States Attorney Carmen M. Ortiz said, “Today, justice was served, and Albania Deleon has finally faced the consequences of her crimes. I hope that this sentence sends a strong message to anyone who might contemplate fleeing to avoid punishment, that we do not give up on fugitives, and we will take all necessary means and resources to apprehend and prosecute them.”
“She ran and tried to hide, but eventually the law caught up with her,” said Michael E. Hubbard, Special Agent in Charge of the US Environmental Protection Agency Criminal Investigation Division in Boston. “Ms Deleon cynically defrauded the taxpayer and put her own workers and the public at risk due to her greed. Today’s sentence shows that individuals who put illegal profits ahead of the welfare of society will deservedly be prosecuted and pay a very high price.”
“This sentencing sends a clear message to employers that seek to gain an unfair business advantage over their competitors by employing illegal workers,” said Bruce M. Foucart, Special Agent in Charge of Homeland Security Investigations in Boston. “The potential risk to public health and safety involving asbestos and lead abatement and training licenses made this investigation and the need to bring this individual to justice even more compelling.”

EPA Issues Press Release On Reducing Asthma Attacks During Summer

US Air Quality Index Map-1/23/2009Image via WikipediaThe Environmental Protection Agency (EPA) warns that hot weather can cause ozone levels to rise, making the air unhealthy to breathe, especially for people with asthma or other respiratory ailments.  Throughout the hot summer months, it’s important to pay close attention to the air quality. Like the weather, air quality can change from day to day or even hour to hour, and can have a serious affect on people’s health.
The Air Quality Index uses a color-coded system to display whether the five major air pollutants exceed air quality standards for the day.  When the Air Quality Index reports unhealthy levels, people, particularly asthmatics and others with respiratory ailments, should limit strenuous outdoor activities.

During the summer when ozone levels rise, the number of people with asthma related symptoms admitted to hospitals and emergency rooms increases.   Asthma rates – especially among children – have increased dramatically.  Asthma affects 25 million people in the United States, including seven million children.  That’s 8 percent of the population.  One out of every 10 school-aged children is affected. EPA Announces the Second Phase of Historic Hudson River Cleanup Underway

Lakes Entrance Dredger April HamerImage via Wikipedia (Glens Falls, N.Y. – June 6, 2011) The U.S. Environmental Protection Agency (EPA) today announced that the dredging of sediment contaminated with polychlorinated biphenyls (PCBs) has resumed in the Upper Hudson River, marking the start of the second and final phase of the Hudson River cleanup.  The historic dredging project targets approximately 2.4 million cubic yards of PCB-contaminated sediment from a forty-mile section of the Upper Hudson River between Fort Edward and Troy, NY.  PCBs are potentially cancer-causing in people and build up in the fat of fish and mammals, increasing in concentration as they move up the food chain.  The primary risk to humans is the accumulation of PCBs in the body from eating contaminated fish.  General Electric (GE) is conducting the cleanup work with EPA oversight, under an agreement with the Agency.  This final phase of the cleanup project is expected to take five to seven years to complete.

During the 2011 dredging season, mechanical dredges will collect buckets of PCB-contaminated sediment from a 1.5-mile stretch of river just south of the town of Fort Edward.  Four to six dredges will work 24 hours a day, six days a week through the summer and fall to remove approximately 350,000 cubic yards of PCB-contaminated sediment from 100 acres of river bottom.  Dredging will begin in the western channel of Roger’s Island and move south in the main stem of the river.  Between 1947 and 1977, an estimated 1.3 million pounds of PCBs were discharged into the river from two GE capacitor manufacturing plants located in Fort Edward and Hudson FallsInformation about the Hudson River PCBs Superfund site can be found at http://www.epa.gov/hudson.

Disposal Company Charged With Illegal Dumping Of Asbestos

Mazza & Sons Inc., located in Tinton Falls, New Jersey, was named in a seven-count indictment of conspiring to dump 60 million pounds of asbestos-contaminated debris at a farm containing wetlands in upstate New York.  Arrested under the indictment were Dominick Mazza, the owner of Mazza & Sons, Julius DeSimone of Rome, New York, Donald Torriero of Wellington, Florida, and Cross Nicastro II of Frankfort, New York.
The indictment describes a scheme to illegally dump thousands of tons of asbestos-contaminated, pulverized construction and demolition debris that was processed at Eagle Recycling’s and Mazza & Sons Inc.’s, New Jersey-based solid waste management facilities.  That asbestos-contaminated debris was then transported to and dumped at Cross Nicastro II’s farm in Frankfort – much of which contained federally-regulated wetlands.  Dumping and excavating operations were managed on-site by Julius DeSimone.
According to court documents, Donald Torriero and other conspirators concealed the illegal dumping by fabricating a New York State Department of Environmental Conservation (DEC) permit and forging the name of a DEC official on the fraudulent permit.   Once the conspirators learned that they were under investigation, they began a systematic pattern of document concealment, alteration and destruction by destroying and secreting documents responsive to grand jury subpoenas and falsifying and submitting environmental sampling to the U.S. Environmental Protection Agency (EPA).
Back in April, NJ.com reported, Eagle Recycling of North Bergen pleaded guilty in federal court to dumping 16.2 million pounds of pulverized construction and demolition debris - including asbestos - at the site and then attempted to destroy documents to conceal it.  As part of the plea agreement, Eagle Recycling agreed to pay a criminal fine of $500,000, to implement an environmental compliance plan at its North Bergen facility, and to pay restitution that potentially includes cleanup costs.

EPA Region 2 Coordinator Discusses the RRP Rule

Environmental journalism supports the protecti...Image via WikipediaOn Friday, April 1, 2011, the Environmental Protection Agency’s (EPA) Region 2 Renovation, Repair , and Painting (RRP) Rule Coordinator Ms. Jeanette Dadusc was discussing the requirements and background of the rule. The topics covered included: introduction to the problem of childhood lead poisoning; Federal government’s response to childhood lead poisoning; how the RRP Rule was developed; the regulated universe of RRP facilities and activities; certification requirements for training providers, individuals, and firms; notification and work practice requirements; cleaning verification card; proposed rule changes; RRP frequent questions; and RRP enforcement strategy.

Her presentation was wide ranging, covered the full time of the presentation, and the handouts supplemented her presentation and were useful.   • Lead based paint is the number one environmental health threat to children
  • Children absorb 50% of the lead they ingest compared to adults, which absorb only 10%.
  • According to the Centers for Disease Control (CDC), there is no known safe level of lead in blood.
  • Discussions are ongoing regarding dropping the standard of lead blood level to 5 micrograms per deciliter (ug/dl) versus the current 10 ug/dl.
  • Lead bioaccumulates in the body because it mimics calcium
  • Children, who live in homes where renovation & remodeling activities were performed within the past year, are 30% more likely to have a blood lead level that equals or exceeds 10 ug/dl.
Some of the points regarding regulated universe of RRP facilities and activities were:
  • Target housing is defined as housing constructed prior to 1978.  There are only 2 exceptions housing for the elderly or for person with disabilities (unless one or more children under 6 years old resides or is expected to reside in such housing), and 0-bedroom dwellings. Meaning hotels, motels, timeshares, and student housing is not exempt.
  • Child Occupied Facility (COF) is defined as a building or portion of a building built prior to 1978 that is visited by the same child under age six for at least 3 hours per day, or at least 6 hours per week, or at least 60 hours per year. This includes common areas routinely used by the children under age 6 (i.e, restrooms, cafeterias), and adjacent exterior areas.
Other major points she covered were:
  • Delead test kit added to the list of EPA approved test kits. The test kits must be used according to the manufacturer’s directions including materials that the test kits cannot be used on.
  • Lead Based Paint Abatement Contractors require RRP Renovator Certification. Previous certification as a worker/supervisor allows the person to take the ½ day refresher class to become a renovator.
  • Lead Waste – residential (homeowners & contractors) can dispose of lead waste bags with household waste. COFs must follow the hazardous waste regulations.

Restoration & Remediation Magazine - The RRP Rule: One Year Later

In this month's issue of Restoration & Remediation Magazine, Mr. John Banta wrote an excellant article regarding the Environmental Protection Agency's (EPA) Lead Paint regulation - Renovation, Remodeling, & Painting Rule.  The article covers the history of the rule and discusses enforcement issues.

As the article discusses the roll-out period for firms to become certified by filing their paperwork and paying their fees to the EPA, as well as for the Certified Renovators supervising these jobs to be trained, was extended to the end of 2010, but the effective date for using lead safe work practices remained April 22, 2010.  As Mr. Banta indicates in his article "this means...that any firm performing work for hire in target housing or child-occupied facilities built prior to 1978 is required to follow the regulations, even if their paperwork hasn’t been processed or even filed."  However, this grace period is over.

The EPA may audit the records of any firm in violation of the regulation for up to three years after the job is complete and be fined up to $37,500 per occurrence per day. If the violation of the law is willful, the fine can be doubled and jail time may be assigned by the courts.  This law applies in all federal jurisdictions; except states, tribes, and territories that EPA has approved to administer their own RRP programs.  According to the article those states are, Wisconsin, Iowa, North Carolina, Mississippi, Kansas, Rhode Island, Utah, Oregon, Massachusetts, and Alabama have had their programs approved in lieu of the Federal program. Approved State programs must be at least as strict as the EPA regulations.
