Several Indicators Show Construction Spending Improving.

A USA Today article dated January 2, 2014 "Construction Spending:Strongest Pace In Years" reported that United States (U.S.) construction spending rose in November at the strongest pace since 2009.  Construction spending increased 1% in November (annually adjusted rate of $934.4 billion).

Residential construction rose 1.9% in November.  Home building last exceeded the November pace shortly before 2008.  Spending on single-family homes has increased 18.4% year over year, while spending on apartment buildings is up 36.3% during the same period.  More than 2/3's of the residential construction market comes from single-family homes.  According to the National Association of Home Builders each new home creates an average of three jobs for a year and generates about $90,000 in tax revenue.

Commercial projects also increased 2.7% in November.  Though Government construction spending fell 1.8%.  Declines in expenditures on roadways, health care facilities, & sewer systems led much of the decrease.

According to the Associated General Contractors of America (AGC) Press Release, November's year-over-year construction employment figures show that employment in the construction industry rose in 211 of 339 metropolitan areas between November 2012 and the same month in 2013.  According to a separate AGC Press Release, construction in November totaled $934 billion, up 5.9% since November 2012.  With private residential construction spending rising 17% and private nonresidential spending rising 1.0% since November 2012.  Public construction dropped 0.2 percent since November 2012.

While the Associated Builders and Contractors's Chief Economist Anirban Basu said the following in their Press Release, "Construction activity bounced back in November, due in part to the end of the federal government shutdown and an accompanying return to normalcy.  Nonresidential construction spending was up 2.3% on a seasonally adjusted basis compared to September, which makes a better comparison because October was so unusual."  "The recent acceleration in economic activity sets the stage for a much better 2014, both for the broader economy and the nonresidential construction industry," said Basu.  "We can expect nonresidential construction spending to expand during the first half of the year."

Filtering Facepiece Respirator or Dust Mask. Which is it?

Well the answer to the question in the title is similar to you saying tomatoe or tomato.  They are two ways of saying the same thing.  According to the Occupational Safety and Health Administration (OSHA) a dust mask is a filtering facepiece respirator.  For those involved in the safety and health field that is not news.  However, for everyone else it is.  In fact, we would argue that the average worker doesn't even consider the dust mask a respirator.  We recently ran into this miscommunication between an employer who was providing filtering facepiece respirators on a voluntary basis and assumed when the OSHA compliance safety and health officer was asking about respirators they were talking about the ones used in the paint booth.  Paint booth respirators were required, but the filtering facepiece respirators were not.  You could imagine the conversation.

What is the consequence of such a miscommunication?  Well once you require the wearing of filtering facepiece respirators in the workplace, these respirators must follow all the requirements of 1910.134 the OSHA respiratory protection standard.  Which means the workers must be medically cleared to wear the respirator, fit tested with the respirator to ensure it fits, and trained on the use of the respirator.  However, if the filtering facepiece respirator is being used voluntarily, all you must provide is Appendix D of standard "Information for Employees Wearing Respirators When Not Required Under The Standard."  A big difference in requirements.  So be very careful when answering this question during an OSHA workplace inspection.

Another problem with dust masks is illustrated by the photo above in an article about Suffolk County's plan to spray pesticides.  What is wrong with the picture?  Well if this worker is spraying pesticides he is wearing the wrong respirator.  Filtering facepiece respirators (dust masks) only protect from dust or particulates.  They do not protect against chemicals that are in the form of mists, vapors, or gases (which is the form that the worker in the picture is spraying).  These forms of chemicals would penetrate through the mask or worse will be absorbed into the filter and potentially concentrate the chemical or allow the chewmical to sit on worker's face.
 
The only reason for wearing a filtering facepiece respirator (dust mask) is for nuisance dusts (i.e., wood dust, pollen, grass clippings, etc.).  Though this respirator is very comfortable, and lighweight, in our view, it is very dangerous because it is readily available, many people are using it improperly, and many people believe it can do more than it was designed to do.  Use this resapirator very carefully and again only for nuisance dusts, nothing more.  Be safe out there!

OSHA 300A Posting Required On Feb.1

Hopefully, you remembered to post your Occupational Safety and Health Administration (OSHA) 300A form on February 1, 2013.  As required by OSHA, the 300A form is the summary of the OSHA 300 form which is the log of injuries and illnesses your company had over the past year.  If your looking for the forms follow this link: http://www.osha.gov/recordkeeping/new-osha300form1-1-04.pdf.  The form is required to be posted from February 1 to April 30, 2013.  If you have 10 or fewer employees this regulation does not apply to your business.

What is recordable under OSHA's Recordkeeping Regulation?
  • Covered employers must record all work-related fatalities.
  • Covered employers must record all work-related injuries and illnesses that result in days away from work, restricted work or transfer to another job, loss of consciousness or medical treatment beyond first aid (see OSHA's definition of first aid below).
  • In addition, employers must record significant work-related injuries or illnesses diagnoses by a physician or other licensed health care professional, even if it does not result in death, days away from work, restricted work or job transfer, medical treatment beyond first aid, or loss of consciousness.
  • Injuries include cases such as, but not limited to, a cut, fracture, sprain, or amputation.
  • Illnesses include both acute and chronic illnesses, such as, but not limited to, a skin disease (i.e. contact dermatitis), respiratory disorder (i.e. occupational asthma, pneumoconiosis), or poisoning (i.e. lead poisoning, solvent intoxication).
  • OSHA's definition of work-related injuries, illnesses and fatalities are those in which an event or exposure in the work environment either caused or contributed to the condition. In addition, if an event or exposure in the work environment significantly aggravated a pre-existing injury or illness, this is also considered work-related.

4,609 workers died on the job in 2011 (as per OSHA website).

What Out-of-State Employers with Employees Working in New York State Need to Know.

We received a recent newsletter from Dan Borgna at the Dale Group.  The newsletter discussed the Workers Compensation/Disability requirements for out-of-state contractors.  We found it very interesting with permission from Mr. Borgna of the Dale Group (Thank you for allowing us to reprint it) here is the newsletter post:  

 
If you have no office location in New York, but have employees on site in NY, this article is important to your business.

New York State workers' compensation insurance covers employees for work-related accidents, injuries or illness.   
As part of the 2007 Workers' Compensation Reform Legislation, all out-of-state employers with at least one employee working in New York State will be required to carry a full statutory New York State workers' compensation insurance policy. The workers' compensation insurance policy must be effective no later than the first day you have employees working in NY State.  

Misconception - "I have all states coverage listed in section 3.c of my home state workers compensation policy".
Reality- As part of the reform, having "all states" in section 3.c is no longer valid. "NY" must be specifically listed in section 3.a of the workers compensation declarations page or endorsement. 
Penalties - Failure to maintain this coverage can result in the following: 

1.     Failure to carry Workers' Compensation Insurance for more than 5 employees within a twelve month period is a class E felony and is punishable by a fine not less than $5,000 nor more than $50,000.

2.     For 5 or less employees within a twelve month period, it is a misdemeanor punishable by a fine not less than $1,000 nor more than $5,000.

3.     Subsequent convictions within a 5 year period shall constitute a class D felony and fines not less than $10,000 nor more than $50,000.

4.     Any employer who fails to maintain a workers' compensation policy when it is required or owes a fine or assessment to the Board may be issued a stop-work order, meaning the business must shut down all activity until the order is lifted.

5.     A penalty in the sum of $2,000 for each ten-day period of non-compliance or a sum not in excess of two times the cost of compensation for the period of such failure may be imposed 

DISABILITY BENEFITS INSURANCE REQUIREMENTS
NY State statutory disability benefits (DB) insurance coverage is totally different from and is not included in NYS workers' compensation insurance coverage. Statutory NY State disability benefits insurance covers employees for off-the-job accident, injury or illness.
If you have one or more employees for 30 days in a calendar year, you are required to obtain NYS disability benefits insurance coverage. Such insurance must be effective no later than four weeks after the 30th day you have employees.  

Penalties under the Disability Benefits Law 

1.     Failure to carry Disability Benefits Insurance is a misdemeanor punishable by a fine of not less than $100 nor more than $500 or imprisonment for not more than one year, or both, with increased monetary penalties for second and third or subsequent violations, and

2.     Where an employee of a non-insured employer is disabled due to an off-the-job injury or illness, the noninsured employer will be responsible for payment of the amount of benefits to which the employee is entitled or for payment of 1% of his/her payroll for the period of non-compliance, whichever is greater. And

3.     Where an employer fails to carry Disability Benefits Insurance, the Chair will impose a penalty not in excess of ½ of 1% of the employer's weekly payroll for the period of non-compliance and a further amount not in excess of $500 

Employees traveling through the State not stopping for deliveries, pick-ups, or other work are not deemed to have worked a day here. An employer that has reason to know that it will meet these criteria in the current year, even if it has not done so in the prior year, must obtain the required coverage.

OSHA Cites SMG For Asbestos Violations at Nassau Coliseum

The Occupational Safety and Health Administration (OSHA) has issued a press release on their website announcing that they are citing SMG, which manages the day-to-day operations of the Nassau Veterans Memorial Coliseum on Long Island, a total of $88,000 in proposed fines for asbestos, electrical, chemical and other hazards facing workers at the coliseum. SMG operates as SMG @ Nassau Coliseum, LLC faces 16 alleged serious violations of workplace health and safety standards.
OSHA opened the inspection due to employee complaints.  Investigators found that maintenance workers and electricians were exposed to asbestos or materials potentially containing asbestos while working in various locations - including the coliseum's ice plant, catwalks, and a loading dock - and that SMG did not take adequate steps to address the hazards.
Obviously, from this information it seems that SMG was unaware (or ignored) the dangers their workers faced in working at the Coliseum.  This is not a good thing for Nassau County as the owners of the Coliseum.  This brings into question what information did Nassau County pass along to SMG to make sure SMG protected their employees.  This opens up Nassau County for a third party litigation lawsuit.  Remember previous articles written about this issue indicated at least two workers (one with mesothelioma and the other with stage four lung cancer) were potentially exposed to asbestos and that a total of 75 arena employees may have been exposed.
One of the most damning statements on the press release was "Specifically, SMG did not identify the presence, location and quantity of materials containing or potentially containing asbestos, use engineering controls and work practices to reduce exposure levels, ensure that all Class III asbestos work (such as repair and maintenance operations where materials presumed to contain asbestos are disturbed) was conducted in regulated areas, ensure proper respirator use, post warning signs and provide asbestos awareness training for workers."  Nassau County as the owner of the Coliseum, also has liabilities in informing SMG of the asbestos containing materials located at the Coliseum.  It seems to us that this isn't the last we will be hearing about the asbestos at the Nassau Veterans Memorial Coliseum.

Happy 4th of July! Celebrate Our Heros And Our Freedoms!

Happy 4th of July, the day we celebrate the founding of our Great Country!  Much blood, sweat, and tears (great name for a band) have been spilled to get to where we are today (please remember and honor our heros today who have served in the various wars - Revolutionary, War of 1812, Civil War, Spanish-American, WWI, WWII, Korean, Vietnam, Cold, Operation Freedom, Afganistan, and Iraq).  In addition, alot of breath, ink, and paper (not so great name for a band) has documented our ups and downs along the path to greatness.  As an American, I haven't always agreed with our direction (as many others at various times) but I have always been proud of my country.  No where else can you state your opinion without fear of being jailed or killed.  No where else do we have the opportunity to become as great or as little as we want to be.  No where else do we get a choice of who to vote for (kind of?).  Though we may disagree with each other on politics (I'm a Progressive, not a Liberal), sports (Go Mets and Steelers!), and religion (I'm a Taoist), in the end we are all Americans, we are all brothers and sisters, and together we can overcome anything!

Worker Exposure to Silica Significant During Hydraulic Fracturing

Just read the National Institute of Occupational Safety and Health's (NIOSH's) blog regarding "Worker Exposure to Crystalline Silica during Hydraulic Fracturing".  Obviously, environmental concerns regarding this type of work are being fought in New York on what seems likely a daily or weekly basis.  Usually the arguement for hydraulic fracturing is, job creation and of course energy independence.  However, it is interesting how worker safety is rarely discussed when we talk about hydraulic fracturing.  This study done by NIOSH and discussed on their blog obviously discusses the need to ensure that workers are protected from being overexposed to respirable crystalline silica dust.  Overexposure to respirable crystalline silica dust can lead to the development of the uncurable respiratory disease silicosis, in addition to other diseases.    The typical view that filtering facepiece and half-mask respirators could protect the workers, according to the blog is not sufficient to protect the workers.  Meaning engineering, work practice controls, and administrative controls need to be implemented, making the process more complicated.
Since New York State Department of Environmental Conservation (NYS DEC) is working on drafting regulations for hydraulic fracturing, we hope they also take into account what is needed to protect worker safety on these sites as well as what is needed to protect the environment.

OSHA Quicktakes Announces HAZCOMM Standard Revision

The March 22, 2012 (Volume 11, Issue 7) of the Occupational Safety and Health Administration's (OSHA) "QuickTakes" anounced "OSHA Aligns HazardCommunication Standard with the United Nations' Globally Harmonized System ofClassification and Labeling of Chemicals."  This announcement has been awaited by the environmental, industrial hygiene, and safety industry for some time now.  The QuickTakes discusses the March 20 press teleconference hosted by Secretary of Labor Hilda Solis joined by Assistant Secretary of Labor for Occupational Safety and Health Dr. David Michaels announcing the final rule updating OSHA's Hazard Communication Standard.

The purpose of the revision is to align the standard with the United Nations' Globally Harmonized System of Classification and Labeling of Chemicals.  The standard should better protect workers and help American businesses compete in a global economy.
Assistant Secretary Michaels explained that OSHA's revised Hazard Communication standard (HCS), which will be fully implemented in 2016, benefits workers by reducing confusion in the workplace, facilitating safety training, and improving understandings of hazards, especially for low-wage and limited-literacy workers. The harmonized standard will classify chemicals according to their health and physical hazards, and establish consistent labels and safety data sheets (SDS) for all chemicals made in the United States or imported from abroad.  For more information, listen to an audio-recording of the press conference and see the press release.
Employers must train workers on the new label elements and SDS format by December 1, 2013. Chemical manufacturers, importers, distributors, and employers must comply with all modified provisions of the final rule by June 1, 2015.  However, distributors may ship products labeled by manufacturers under the old system until December 1, 2015.  By June 1, 2016, employers must update alternative workplace labeling and hazard communication programs as necessary, and provide additional worker training for new identified physical and health hazards.  During this transition period, all chemical manufacturers, importers, distributors, and employers may comply with either 29 CFR 1910.1200 (this final standard), or the current standard, or both.

Honoring Dr. Alice Hamilton For Women's History Month

Recently saw a tweet by the Young Workers honoring Dr. Alice Hamilton (For Women's history month -- Alice Hamilton (NIOSH video 1988; http://www.youtube.com/watch?v=E75pST2QTEM&feature=colike).  It still surprises us when we see a video on the pioneers in the industrial hygiene field, discussing issues we are still dealing with today.  Dr. Hamilton was dealing with imigrant labor being mistreated similar to what we see today with undocumented/illegal aliens.  Dr. Hamilton also was dealing with workers being exposed to various toxic dusts and then the workers developing various diseases caused by these exposures.  Today we still see this happening as we've written about in our current newsletter (Toxic Dusts - Demolition Implications).  When will we learn from our previous mistakes?  When will we stop the exposures and the resulting illnesses?  When will we start to care?

Interesting study showing the number of construction industry workers fell from 2009. However, more interesting is the fact that 55% of construction workers are doing without health insurance. That is up from 53% from 2009. Another interesting statistic is that Black non-Hispanics were up 2% from 2009; and Asian workers were up 12% from 2009.  Though these statistics indicate what most of us already knew, that the economy is significantly hurting the construction industry.  We hope the New Year will bring new projects into construction industry.

New OSHA Website For Winter Storms

Just before the holidays, the Occupational Safety and Health Administration (OSHA) published a new website regarding Winter Storms.  Even though the northeast got snow on halloween, so far this year it has been tame regarding winter storms.  Last winter was a different story, which is probably the reason OSHA has published this informational site to assist employers in proteecting workers from the anticipated hazards associated with winter storm response and recovery operations that workers are likely to conduct.


The site provides information in preparing for a winter storm, response and recovery, and additional resources.  Preparation includes such things as listening to the National Oceanic and Atmospheric Administration (NOAA) weather radio or going to the NOAA Watch website for information on the storm, winterizing your car, preparing and carrying an emergency kit.  Response and recovery includes information regarding the different hazards workers may face, such as driving/vehicle accidents, carbon monoxide poisoning, hypothermia and frostbite, exhaustion, dehydration, back injuries and heart attack, slips and falls, electrocution, burns, being struck by falling objects, roof collapse, and lacerations or amputations.
The site is a very good source of information for preventing the hazards discussed above.  In particular the winterizing your car part is very helpful in getting yourself ready for the winter storms that are only a matter of time before they get here.

Read The Preamble, To Better Understand The Standards

The OSHA Training Blog a couple of months ago had an interesting post discussing how to better understand OSHA standards.  The post was titled "Want to Really Understand an OSHA Standard? Read the Preamble!".  This post discussed the importance of the preamble to the regulatory process.  Most importantly, the importance of the preamble in discussing want went into creating the standard.  For understanding the standard the section that will provide the most information is titled "Summary and Explanation of the Standard".  So, next time you want more information on a standard, a good place to start is the preamble.

CDC Website Discusses Earthquakes

The Centers for Disease Control has updated their Emergency Preparedness and Response website with information on surviving an Earthquake.  Considering we had a small one on the east coast this year, that we even felt on Long Island, it is important to be prepared and knowledgeable about what to do.  The website discusses the things you can do before, during, and after the earthquake.  The key point of the website is that in MOST situations, you will reduce your chance of injury from falling objects (and even building collapse) if you immediately: 


The website discusses emergency supplies, and inspecting the home for hazards.  One of the more interesting suggestions is the following from "Inspecting Home for Hazards:"  - Check to see if your house or garage is securely fastened to the foundation. (If your house was built before 1950, it probably does not have bolts securing the wood structure to the concrete foundation.)  If your house is not secured to the foundation, take the following steps:
  • Using a hammer drill and carbide bit, drill a hole through the sill plate into the foundation. Holes should be approximately 6 feet apart.
  • Drop a 1/2- x 7-inch expansion bolt into each hole and finish by tightening the nut and washer
We suggest you visit the website, so you can be prepared, just in case we get a more severe earthquake, next time.

Total Environmental & Safety Blog Post - Discusses Economic Prosperity

As an Indoor Air Quality Professional we agree completely with Mr. Ralph Carito's blog post on Total Environmental & Safety's blog.  His post "Linking EHS, Ethics and Economic Prosperity", is another post that shows how environmental health and safety regulations not only don't drive up costs but actually allow companies to be more competitive, more risk averse, and more efficient.  Helping companies become more competitive.

Safety Regulations Don't Add Costs They Decide Who Pays Them

Robert S. Adler, who is a lawyer and a commissioner of the Consumer Product Safety Commission, wrote an excellent Op-Ed piece in the New York Times defending regulations.  With the daily barrage of individuals complaining about regulations and how regulations are stifling employment.  His Op-Ed piece "Safety Regulations Don't Add Costs They Decide Who Pays Them" tells us what these individuals complaining about over-regulation are leaving out.  That these costs are already being paid for by society (us) including death, injury, and increased costs for health insurance (or taxes for the uninsured).  We totally agree with his points, and his points also apply to environmental and occupational safety regulations.  Where the numbers may be a little more murky (i.e., relations with asthma and pollution, and productivity and safety), nonetheless, regulations basically ensure the company producing the product pays the cost.  Society pays for the true price of the product and decides whether that product is worth buying.

The National Institue of Occupational Safety and Health (NIOSH) and the Occupational Safety and Health Administration (OSHA) have a new publication called "Nail Gun Safety: A Guide for Construction Contractors."  This publication was created as a resource to prevent injuries in the construction industry, including residential construction.  While nail guns may boost productivity, nail guns are responsible for tens of thousands of painful injuries each year.  One study found that 2 out of 5 residential carpenter apprentices experienced a nail gun injury over a four-year period.  When these injuries occur they are often not reported or given any medical treatment.  The risk of injury is twice as high when using a multi-shot contact trigger versus using a single-shot sequential trigger nailer.  Many years ago, Linda Archipolo of Massapequa made the news on Long Island, when she was working in a Burger King at the Sunrise Mall.  A three-inch nail, shot with a nail gun, accidentally went through two walls and landed in Ms. Archipolo's skull.  Luckily, she survived.  This new publication is intended for residential home builders and construction contractors, subcontractors, supervisors and workers to prevent these kinds of injuries.

The guidance was developed in response to a unanimous recommendation by employer, labor and public members of OSHA’s Advisory Committee for Construction Safety and Health (ACCSH), asking OSHA to develop awareness and materials about nail gun risks.  OSHA and NIOSH worked together to make sure the guidance reflects the most current information available. The publication highlights what is known about nail gun injuries, describes the common causes of nail gun injuries and provides six practical steps that contractors can take to prevent these injuries. The guidance includes actual workplace cases along with a short section on other types of nail gun hazards and sources of additional information.
